These Terms and Conditions ("Terms") govern your use of this website and your purchase of HummingbirdX products through the FMFT eStore. HummingbirdX is operated by Functional Medicine Fast Track, LLC ("we," "us," or "our"), located at 870 N Miramar Avenue #445, Indialantic, FL 32903. By using this website, you agree to these Terms. If you do not agree, do not use the website.
1. Eligibility
You must be at least 18 years old to purchase products or create an account on the FMFT eStore. By using this website you confirm that you are 18 or older and legally able to enter a binding agreement.
2. Use of the Website
You agree not to: use the website for any unlawful purpose; attempt to gain unauthorized access to our systems; introduce malware or interfere with site operation; scrape or harvest data without our written permission; or submit false or misleading information.
3. Products and Health Information
Our products are dietary supplements. Please read the Disclaimer above, which forms part of these Terms. You are responsible for deciding whether a product is appropriate for you and for consulting your healthcare provider before use.
4. Orders and Acceptance
HummingbirdX is an educational website. Orders, payment, and shipping are completed on the FMFT eStore (shop.fmforlife.com) and these Terms govern purchases of HummingbirdX products made through the eStore. Returns are handled under the eStore's Return Policy (see Section 7). Placing an order on the eStore is an offer to buy. We may accept or decline any order, and we may limit quantities, for reasons including product availability, pricing errors, suspected fraud, or violation of these Terms. An order is accepted when we send a shipping confirmation. If we cancel an order after charging you, we will refund the charge.
5. Pricing and Payment
Prices are in U.S. dollars and may change without notice. Prices do not include shipping and applicable taxes, which are shown at eStore checkout. Payment is processed on the eStore by third-party payment providers. This website does not collect or store your card number. When you check out, you authorize the eStore to charge your chosen payment method for the total order amount.
6. Shipping
Orders ship from the FMFT eStore to all U.S. states. Estimated delivery times are not guaranteed. Risk of loss passes to you upon delivery to the carrier. You are responsible for providing an accurate shipping address; we are not liable for orders delivered to an incorrect address you supplied.
7. Returns, Refunds, and Cancellations
Returns are handled through the FMFT eStore (shop.fmforlife.com) under its Return Policy. The eStore accepts returns on most unopened products postmarked within 30 days from the date the order was shipped; see its Return Policy for full details. Please review your order carefully before checking out. If your order arrives damaged, defective, or incorrect, email [email protected] within 14 days of delivery with your order number and photos, and we will replace the product or refund you at our discretion. Approved refunds go back to the original payment method. Orders can be changed or canceled only before they ship; email us as soon as possible.
8. Subscriptions
Subscriptions are set up and managed in your eStore account. If you choose a subscription, you authorize recurring charges at the interval you select until you cancel. You may also cancel anytime by emailing [email protected] before your next billing date. We will remind you of renewals as required by law.
9. Intellectual Property
All content on this website, including the HummingbirdX name, logo, text, graphics, images, product labels, and design, is owned by or licensed to Functional Medicine Fast Track, LLC and protected by copyright, trademark, and other laws. You may view and print content for personal, non-commercial use. You may not copy, modify, distribute, or use our content or marks commercially without our prior written consent.
10. User Submissions and Reviews
If you submit reviews, comments, photos, or other content, you grant us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, and display it in connection with our business. You confirm you have the right to submit it and that it is truthful and not unlawful or infringing. We may remove submissions at our discretion. Reviews must reflect your genuine experience; do not make disease treatment or cure claims in reviews.
11. Disclaimer of Warranties
THE WEBSITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY PRODUCT WILL PRODUCE A PARTICULAR RESULT.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, Functional Medicine Fast Track, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS OR DATA, ARISING FROM YOUR USE OF THE WEBSITE OR PRODUCTS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM. Some jurisdictions do not allow certain limitations, so these may not apply to you. You use supplements at your own risk and agree to follow label directions. These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. You agree that any dispute will be brought exclusively in the state or federal courts located in Brevard County, Florida, and you consent to their jurisdiction.

The website may link to third-party sites, including our shop at shop.fmforlife.com. Their privacy practices apply there; purchases of HummingbirdX products made through our shop are governed by these Terms. We are not responsible for third-party content or services.
16. Changes and Termination
We may update these Terms at any time by posting the revised version with a new "Last updated" date. Continued use after changes means you accept them. We may suspend or terminate your access at any time for violation of these Terms.
17. General
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, with the Disclaimer and Privacy Policy, are the entire agreement between you and us regarding the website.
